High Court stays transfer of special school employee

Aaya claims transfer was retaliatory over pay and pension issues

The Vacation Bench of the High Court of Bombay at Goa has stayed the transfer order of Sujata Zore, an aaya at Sanjay Centre for Special Education, after she challenged the move, claiming it was a retaliatory action by the school management.

Zore had challenged the April 30 transfer order issued by headmaster Tatu Kudalkar, along with the transfer of seven other employees working at the special school.

In the petition, Advocates Shashikant Joshi and Swapna Joshi, appearing for Zore, alleged that she was transferred out of vengeance for helping file writ petitions before the High Court over an alleged shortfall in pay scales and alleged misappropriation of employees’ contributions under the National Pension Scheme.

She relied on a petition filed by 17 aayas, which is scheduled to come up for hearing before the High Court on June 23.

The petitioner further alleged that the school management tried to victimise her for leading other employees in raising issues that had brought the management’s functioning under judicial scrutiny.

Zore also argued that the transfer order was illegal as the headmaster had no authority to issue such orders without the approval of the managing committee and without giving any reason for the transfer.

After hearing both sides, the Vacation Bench of Justice Jitendra Jain on Wednesday stayed the transfer order till the next hearing on June 8, when the High Court resumes proceedings.
