Court acquits accused for lack of evidence in Chimbel fatal accident case

The Chief Judicial Magistrate Court, Merces has acquitted Venkatesh Jadhav in a fatal road accident case arising from the death of Ajay Kamble in Chimbel in July 2023. The CJM held that prosecution failed to establish the charges beyond reasonable doubt.

Jadhav was charged under Sections 304-A and 279 of the Indian Penal Code for causing death by negligence and rash driving, along with provisions of the Motor Vehicles Act for allegedly failing to assist the victim and report the accident.

The case pertained to a hit-and-run accident in Chimbel in which an Ashok Leyland rickshaw bearing registration number GA-07-T-0855 allegedly collided with an Activa scooter rider near Kinara Bar while proceeding from Chimbel towards Ribandar.

As per the case details, the rickshaw driver was allegedly driving rashly and negligently and fled the spot after the accident, leaving the vehicle behind. Kamble later died of injuries sustained in the crash.

Police later identified and arrested Jadhav, 29, in connection with the case.

In its order on Thursday, the court observed that the prosecution had failed to produce sufficient evidence to prove the allegations against the accused, leading to his acquittal.

The ruling comes after another acquittal in the Campal fatal accident case involving accused Mayur Dhond, in which the court had similarly cited insufficient evidence while clearing the accused of charges.
