BIRCH HEALTH NOC CASE: Court grants anticipatory bail to excise official

The Additional Sessions Court in Mapusa has granted anticipatory bail to Gauresh Gawas, an Upper Division Clerk with the Excise Department, in the alleged Birch Health NOC forgery case being investigated by Mapusa Police.

During the hearing, the prosecution told the court that Gawas had fully cooperated with investigators and was not considered an accused, but a “material prosecution witness” in the probe against the Luthra brothers and Ajay Gupta.

Police had opposed the plea, citing the ongoing investigation. However, after hearing both sides, the court granted him protection from arrest. The case concerns the alleged fabrication and misuse of a No Objection Certificate linked to Birch Health. Police are continuing to investigate the circumstances surrounding the alleged forged document and the role of the accused. Sources said the court considered Gawas’ cooperation and witness status while granting bail.
